Tell Me Group Terms and Conditions
1. Introduction
1.1 These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Tell Me Media Pty Ltd (ABN 25 155 148 093) (“Tell Me Group”, “we”, “our”, or “us”), including our websites (tellmebaby.com.au, tellmepets.com.au, tellmeshopper.com.au, and any subdomains), mobile applications, and the Tell Me Rewards Program.
1.2 By accessing or using our services, you agree to be bound by these Terms and all applicable laws and regulations.
2. Definitions
- “Tell Me Group” refers to Tell Me Media Pty Ltd (ABN 25 155 148 093) and its websites, services, and mobile applications.
- “Websites” refers to tellmebaby.com.au, tellmepets.com.au, tellmeshopper.com.au, and any associated subdomains.
- “User” refers to any person who accesses the Tell Me Group services, whether as a guest or a registered user.
- “Tell Me Group Services” refers to all services provided by Tell Me Group, including the Websites, Tell Me Rewards Program, mobile applications, and any other access methods.
- “Content” refers to any information, text, data, graphics, images, audio, video, or other material submitted, posted, or displayed on the Tell Me Group Services by users or Tell Me Group.
3. Eligibility and Registration
3.1 To register and use the Tell Me Group services, you must:
- Be an individual (not a business or organization).
- Be at least eighteen (18) years of age.
- Provide accurate and complete registration information.
- Use the services for their intended purpose and in a lawful manner.
3.2 We reserve the right to refuse registration or terminate your account at our sole discretion.
4. Account Security
4.1 You are responsible for maintaining the confidentiality of your username and password and for all activities that occur under your account.
4.2 You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
5. User Obligations and Acceptable Use
5.1 When submitting Content to Tell Me Group, you guarantee that:
- You own or have the necessary rights to use and license the Content.
- The Content is accurate, complete, and does not violate these Terms or any applicable laws.
- The Content will not cause harm to any person or entity.
5.2 You agree not to:
- Violate any applicable laws or regulations.
- Engage in bullying, harassment, or intimidation of other users.
- Post hateful, threatening, defamatory, or offensive Content.
- Infringe on any intellectual property rights, including copyright, trademark, and privacy rights.
- Use automated methods (such as bots, spiders, or scrapers) to access the services without our permission.
- Interfere with the proper working of the services, including attempting to overload, disrupt, or damage our systems.
- Create multiple accounts or access another user’s account without permission.
- Submit any Content containing viruses, worms, or other malicious code.
- Collect or harvest any personal information of other users.
- Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
6. Product Review Policy
6.1 When posting reviews, you agree to:
- Be respectful, honest, and objective.
- Provide sufficient details about the product, including the product name, model number, and your experience with it.
- Write original reviews and avoid plagiarism.
- Refrain from personal insults, harassment, or offensive language.
- Not use the platform for marketing, advertising, or selling products.
6.2 Tell Me Group reserves the right to:
- Edit or delete reviews that violate these Terms.
- Verify the authenticity of reviews and user accounts.
- Suspend, terminate, or delete accounts that violate these Terms.
7. Tell Me Rewards Program
The Tell Me Rewards Program offers two ways to earn rewards:
A. Review Products and Earn Points
7.1 Earn Points:
- You can earn reward points (“Points”) by submitting product reviews. Points are awarded as follows:
- 100 points for every product you review (with or without photos)
- 300 points for a featured product review
- 400 points for a featured product review with 3 or more original photos.
- Featured products are identified by a bonus points badge.
- To earn Points, you must have a verified account.
- Make sure you follow our Review Guidelines [link to your review guidelines page] so your reviews and photos are eligible to earn Points.
- Points are awarded at the discretion of Tell Me Group. Points will not be awarded for reviews that have been duplicated, not published, reviewed by a user who is not believed to own/has not used the product, or do not meet the word limit of at least 50 words.
- If reviews are suspected of being fake, we have an obligation under the Competition and Consumer Act 2010 to remove the review from the site or not publish it, and these reviews will not be eligible for Points.
7.2 Redeem Points:
- You can redeem your points for rewards when you earn the following points:
- 3000 points = a $20 gift card from selected retailers or a Prezzee Smart e-gift card.
- You can claim each reward only once.
- To claim your Points as a gift card:
- Go to your profile page.
- Click the ‘Redeem’ button. If the button is not active, it means you do not have enough Points yet.
- A popup will appear allowing you to select which reward you want to redeem.
- If you have enough Points to redeem more than one gift card, repeat the steps above for each reward.
- If it’s your first time redeeming Points, we’ll need to verify your ID (see Section 7.3). This only needs to be done once.
- Points are not transferable, exchangeable, or redeemable for cash.
7.3 ID Verification:
- Before redeeming Points for the first time, you must provide a valid form of photo ID, such as a driver’s licence. This is to ensure that member accounts are legitimate and belong to real people who reside in Australia.
- You can provide your ID to us at any time using [link to your ID verification form]. You will be asked to send photos of the card – both the back and front. You can edit out your licence number and signature – we just need to see your name, address, date of birth and photo.
- We may ask to see additional proof of residency at any time during your membership.
- If you don’t have a licence or proof of age card, please email us at community@tellmegroup.com and we will organise another option for you.
7.4 Reward Delivery:
- It currently takes around 8-10 weeks to receive a Coles/Kmart/Target voucher after ordering.
- It takes around 10-12 weeks to receive your Prezzee Smart e-gift card via email after placing your order and verifying your ID.
- The email sender will show as ‘Tell Me Baby’ and the email address is delivery@mail.prezzee.com.au. Please check your spam folder as it may end up there.
B. Earn Cashback When You Shop
7.5 Eligibility:
- To participate in the Cashback Program, you must meet the eligibility requirements outlined in Section 3 and have a valid Australian bank account.
- Start by linking your eligible Visa or Mastercard debit and credit cards to automatically earn when you shop online with our brand partners.
- We do not store or save your credit/debit card details.
7.6 Earning Cashback Rewards:
- You can earn Cashback Rewards (“Cashback Rewards”) by making eligible purchases (“Eligible Purchases”) through our brand partners.
- As part of your membership, you can access exclusive offers through our Cashback offer partners.
- The amount of Cashback Rewards you earn will vary depending on the specific offer and the retailer.
- Your cashback is tracked at the time of purchase, and once cleared, is available to redeem once you have reached a $10 balance in your account.
- We reserve the right to adjust or cancel Cashback Rewards in cases of fraud, technical errors, returns, cancellations, or violations of these Terms.
7.7 Eligible Purchases:
- An Eligible Purchase is a purchase made through a Tell Me Group brand partner that meets the requirements of the specific cashback offer.
- The following are not considered Eligible Purchases:
- Purchases made using a card that is not linked to your account.
- Purchases made outside of the specified offer period.
- Purchases that are cancelled, returned, or refunded.
- Purchases that are deemed fraudulent.
7.8 Redeeming Cashback Rewards:
- You can redeem your Cashback Rewards once you have accumulated a minimum balance of $10 in your Tell Me Rewards account.
- Cashback Rewards can be redeemed for direct deposit into your nominated Australian bank account.
- The maximum amount of Cashback Rewards that can be redeemed at one time may be limited.
- It is your responsibility to provide accurate bank account details for redemption. We are not liable for any errors in the provided information.
7.9 Inactive Accounts:
- If your Tell Me Rewards account remains inactive for a specified period, your Cashback Rewards may expire.
- We will attempt to contact you before your rewards expire.
7.10 Prohibited Activities:
- You must not engage in any activity that may interfere with the Cashback Program, including but not limited to:
- Creating multiple accounts to earn extra Cashback Rewards.
- Using automated methods to activate cashback offers.
- Manipulating transactions to earn Cashback Rewards fraudulently.
- Violating any of the terms and conditions of the retailers participating in the Cashback Program.
General Provisions for Tell Me Rewards Program
7.11 Tell Me Group reserves the right to modify or terminate any aspect of the Tell Me Rewards Program, including the Points system and the Cashback Program, at any time.
7.12 We make no warranties or representations about the availability or accuracy of the Tell Me Rewards Program or any offers within it.
7.13 We are not responsible for any losses or damages you may incur in connection with the Tell Me Rewards Program, except to the extent required by law.
8. Content Licensing
8.1 You retain ownership of any Content you submit to the Tell Me Group Services. However, by submitting Content, you grant Tell Me Group an exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, copy, modify, distribute, display, and create derivative works of that Content for any purpose.
8.2 This license includes the right for Tell Me Group to use your Content in connection with the Tell Me Rewards Program, including but not limited to, marketing and promotional materials.
9. Intellectual Property
9.1 All Content created or produced by Tell Me Group, including the design and layout of the Websites, is protected by copyright and other intellectual property laws.
9.2 You may use the Content for personal or educational purposes, but commercial use is prohibited without our express written permission.
9.3 All trademarks, service marks, and logos used on the platform are owned by Tell Me Group.
10. User Content
10.1 By submitting Content to Tell Me Group, you represent and warrant that you have all necessary rights to grant us the license in Section 9.
10.2 You agree to indemnify and hold Tell Me Group harmless from any claims arising from your Content or your use of the services.
11. Third-Party Links and Content
11.1 The Websites may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of these websites.
11.2 You agree not to infringe on any third-party rights when using our services.
12. Disclaimer and Limitation of Liability
12.1 Use of the Tell Me Group services is at your own risk.
12.2 We make no warranties or representations about the availability, accuracy, reliability, or completeness of the services.
12.3 To the maximum extent permitted by law, we exclude all liability for any loss or damage arising from your use of the services, including but not limited to indirect, incidental, special, consequential, or punitive damages.
12.4 If any liability cannot be excluded by law, our liability is limited to the resupply of the services or the amount you paid us to use the services, whichever is lower.
13. Termination
13.1 You may terminate your use of the services at any time.
13.2 We may suspend or terminate your access to the services for any violation of these Terms or for any other reason at our sole discretion.
14. Governing Law
14.1 These Terms are governed by the laws of New South Wales, Australia.
15. Entire Agreement
15.1 These Terms constitute the entire agreement between you and Tell Me Group regarding the use of our services and supersede any prior agreements.
16. Severability
16.1 If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck out and the remaining provisions will remain in full force and effect.
17. Waiver
17.1 No waiver of any provision of these Terms will be effective unless in writing and signed by Tell Me Group.
